Global Terms and Conditions of Use

1.Interpretation and Definitions

Interpretation

Words with initial capitalized letters have meanings defined under the following conditions. Definitions shall have the same meaning regardless of whether they appear in singular or plural form.

Definitions

For the purposes of these Terms and Conditions:

  • Company:(referred to as "the Company", "We", "Us", or "Our") refers to Conocimiento Universal QS.
  • Account:the unique and personal account created for You to access our Service, courses, and member portal on cuqs.org.
  • Content:text, images, audio files, video lessons, comments, or other information published, uploaded, or made available on the Service.
  • Device:any equipment capable of accessing the Service, such as computers, mobile phones, or tablets.
  • Service:the web platform accessible from https://www.cuqs.org, including its subdomains, private user areas, and associated applications.
  • You:the individual or legal entity accessing or using the Service.

2.Acceptance and Age Requirements

By accessing or registering on cuqs.org, you agree to be bound by these Terms as well as our Privacy Policy, Disclaimer, and Cookie Policy.

  • Minimum Age:You declare that you are at least 18 years of age (or the legal age of majority in your jurisdiction). Use of the Service and creation of accounts by individuals under 18 is strictly prohibited.
  • Global Operation:This agreement applies to users worldwide (United States, Latin America, European Union, United Kingdom, Asia-Pacific, Middle East, Africa, and Oceania).

3.User Accounts and Member Area

  • Data Accuracy:When creating your account, you must provide truthful, accurate, and up-to-date information. Providing false information constitutes a material breach of these Terms.
  • Credential Security:The user is solely responsible for maintaining the confidentiality of their access credentials (magic links / associated email) and for all activity occurring within their account. You must notify contact[at]email.cuqs.org immediately of any security breach or unauthorized access.
  • Usernames:Defamatory, vulgar, infringing third-party trademarks without authorization, or impersonating any individual or entity as a username is strictly prohibited.
  • Personal and Non-Transferable Use:Access to courses and materials within the member area is strictly personal. Sharing login credentials with third parties is strictly prohibited.

4.Content Standards and Usage Restrictions

User-Generated Content

Our platform may offer interaction areas or community testimonials. You retain ownership of content you post, but grant the Company a worldwide, non-exclusive, royalty-free license to use, host, and display such content within the Service.

Prohibited Uses

You agree not to use the Service to:

  • Post or transmit unlawful, defamatory, discriminatory (based on race, religion, gender, or sexual orientation), threatening, or obscene content.
  • Send spam, unsolicited messages, or unauthorized marketing schemes.
  • Upload or distribute malicious code, viruses, trojans, or scripts that impair the performance or security of cuqs.org or its servers.
  • Attempt to breach infrastructure security or reverse-engineer the source code of the Service.
  • Infringe copyright, trademark, or trade secret rights of the Company or any third party.

The Company reserves the right to remove any content and immediately suspend or terminate the account of any user who violates these restrictions, without entitlement to refund, except as provided under Section 6bis for store purchases within the statutory withdrawal period.

5.Intellectual Property and Copyright

Ownership: The Service, its source code, UI/UX design, logos, trademarks, educational materials, audio tracks, meditations, and videos are the exclusive property of Conocimiento Universal QS and are protected by international copyright and intellectual property treaties.

Limited Use: Reproduction, distribution, commercial exploitation, modification, or public communication of cuqs.org content without prior written consent from the Company is strictly prohibited.

Copyright Infringement Notice and Takedown Procedure:

If you believe your copyrighted work has been copied on our Service in a manner that constitutes infringement, please submit a written notification to contact[at]email.cuqs.org containing:

  1. Physical or electronic signature of the copyright owner or authorized representative.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the allegedly infringing material and its exact location (URL) within the Service.
  4. Contact information of the claimant (full name, address, telephone number, email).
  5. A statement of good-faith belief that the disputed use is not authorized by the copyright owner, agent, or the law.
  6. A statement made under penalty of perjury that the information provided is accurate and that you are authorized to act.

6.Backups and Service Availability

  • Backups:While we perform automated routine backups of the platform database, users remain responsible for maintaining independent copies of their personal data. The Company does not guarantee data recovery in cases of force majeure or events beyond reasonable operational control.
  • Technical Maintenance:The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the website will be uninterrupted, error-free, or exempt from temporary connectivity outages.

6bis.Right of Withdrawal — Store Purchases

If you purchase physical or digital goods in /tienda (or equivalent store routes):

  • Colombia:under the Consumer Statute (Law 1480 of 2011), you have the right to withdraw from the purchase within five (5) business days following product delivery without justification, subject to statutory exceptions.
  • European Union:if purchasing as a consumer residing in the EU, the statutory cooling-off period under the Consumer Rights Directive is fourteen (14) calendar days from receipt of the product.
  • Exercise of Right:To exercise this right, contact contact[at]email.cuqs.org or our official WhatsApp channel stating your order number. Returned items must be in original condition, subject only to reasonable inspection handling.
  • Independent Legal Warranty:This statutory right of withdrawal is independent of any statutory conformity warranty and cannot be restricted by internal company policies or Section 4 of these Terms.

7.Links to Third-Party Websites

The Service may contain links to third-party platforms or services (e.g., messaging apps, video hosting platforms, social networks). The Company assumes no responsibility for content, privacy policies, or operational practices of external services.

8.International Limitation of Liability

To the fullest extent permitted by applicable law in your jurisdiction:

  • Damage Waiver:The Company, its officers, instructors, and affiliates shall not be liable for indirect, incidental, punitive, special, or consequential damages (including loss of profits or loss of data) arising from the use of the Service.
  • Financial Cap:The total aggregate liability of the Company for any claim shall not exceed the amount paid by the user in the preceding three (3) months or $100 USD, whichever is greater.
  • Express Non-Waivable Carve-Outs:Nothing in this section excludes or limits liability for bodily injury, death, intentional misconduct, gross negligence, fraud, or non-waivable statutory consumer protections in the user’s jurisdiction (including the right of withdrawal set forth in Section 6bis).

9.Applicable Law and Dispute Resolution

  • Direct Settlement:In the event of any controversy or claim, the user agrees to first attempt amicable resolution by contacting contact[at]email.cuqs.org.
  • Jurisdiction:Except where mandatory consumer protection statutes require local venue, these Terms are governed by the laws of the Republic of Colombia, and disputes shall be subject to the competent courts of Colombia.
  • Class Action Waiver:Where permitted by applicable law (such as in the United States), disputes must be resolved on an individual basis and not as a plaintiff or class member in any class, collective, or representative proceeding.

10.Modifications and Severability

  • Modifications:We reserve the right to amend these Terms at any time. Material modifications will be announced via the website or email with at least 30 days notice. Continued use of cuqs.org constitutes acceptance.
  • Severability:If any provision of these Terms is deemed unlawful or unenforceable, the remaining provisions shall continue in full force and effect.
